Record, Northwest N.J., Sunday, August 10, 1980 pFirm Cooperating In Pollution Probe By LAURIE PETERSEN Staff Writer PARSIPPANY The company suspected of polluting ground water in Lake Intervale will cooper-late "100 percent" with all requests by governmental agencies, the plant manager said on Friday. While qualifying his comments -as not meant in a "derogatory sense," Biondo said "the planning board wanted to cooperate with the people and didn't request the usual information for the plan because it is a non-profit organization and they accepted the plan without a great degree of interrogation." Councilman Norbert Socolowski said it did not seem fair to penalize the association now because the situation was "worse months ago but the township was not following up." Police Accident Being Investigated By DIANA KURYLKO Staff Writer MORRIS PLAINS The borough council has hired a special prosecutor to determine whether charges will be filed against a police officer who was involved in car accident while on duty.

Donald Belsole, a Morristown attorney, will investigate a June 23 accident to determine whether Police Chief James Ketch should level charges against 31-year-old Patrolman Thomas Vigilante, a local resident. Vigilante totaled a 1980 police car at 10: 46 a.m. on Hanover Avenue in Parsippany. According to an accident reported filed by Parsippany police, Vigilante, responding on an emergency call, was driving east, approached a curve and apparently applied his brakes and hit a pickup truck driven by Harry Onuskonych, 20, of South Mt. View Long Valley.

Both vehicles were destroyed and Vigilante and Onuskonych were taken to Morristown Memorial Hospital, treated for cuts and bruises and released. Borough council members and the police chief said they didn't want to comment on the incident since no formal charges have been filed. It is also unknown what charges would be made and where Vigilante was heading at the time of the accident. According to Onuskonych, the borough's insurance carrier paid him $2,099 for his 1973 vehicle, doctor bills and two weeks salary for the time he was out of work because of the accident. Onuskonych said he left his job at the Morris County Shade Tree Commission early that day because he was sick.

He said Vigilante lost control at the curve and the front of the police car hit his truck on the driver's side. Onuskonych could not estimate how fast the police car was traveling. Should Ketch file disciplinary charges against Vigilante, the borough council would hold a hearing and act on the evidence as presented by Belsole, said Councilman Howard Leach. The special prosecutor was selected because a police officer was involved, Leach said. Councilman Ted Benning said he did not know the circumstances of the case, or why the incident was not handled internally in the police department.

Vigilante was away on vacation and could not be reached. The borough received $4,960 from its insurance company for the police car, which it kept to use for spare parts.
